§ 7-25. Allocation of fines, penalties and forfeitures.

  • For all enforcement actions initiated by any sworn law enforcement officer under the county sheriff and prosecuted by or in the name of the sheriff or the State of Florida, then all fines, penalties and forfeitures assessed by the court or recovered shall be retained by the sheriff except as otherwise required to be shared with, or turned over to, the State of Florida. For all enforcement actions initiated by the Florida Fish and Wildlife Commission or the Florida Marine Patrol and prosecuted by or in the name of the respective state agency or the State of Florida, then all fines, penalties and forfeitures assessed by the court or recovered shall be retained by the respective initiating state agency except as otherwise required to be shared with, or turned over to, the State of Florida. For all enforcement actions initiated and prosecuted by or in the name of the county, then all fines, penalties and forfeitures assessed by the court or recovered shall be retained by the county except as otherwise required to be shared with, or turned over to, the State of Florida.
