§ 3-47. Membership.

  • (a)

    The AAC shall consist of seven (7) members. Five (5) members shall be appointed and serve at the discretion of the Board of County Commissioners and two (2) members shall be appointed and serve at the discretion of the County Administrator. All appointees shall be residents and registered voters of Hernando County, Florida.

    (b)

    The AAC members shall serve staggered terms and the term of office shall be for four (4) years. If a vacancy occurs prior to the expiration of any member's full term, the Board of County Commissioners shall advertise the position and fill the vacancy with another candidate according to subsection (a) above per appointment status.

    (c)

    All members of the AAC shall serve without compensation; none are entitled to pension or retirement benefits for service on the AAC.

    (d)

    The AAC shall hold public hearings six (6) times a year in the chambers of the Board of County Commissioners. The AAC's agenda will be prepared and published in the same manner as that of the Board of County Commissioners. The County Administrator shall cancel any scheduled hearing at which the AAC has no business to conduct.

    (e)

    The AAC shall have a chair and a vice-chair to conduct each meeting.

    (f)

    For the purpose of transacting business at any meeting, a majority of AAC members shall constitute a quorum.

    (g)

    A member who is seeking re-appointment shall continue to be a voting member for two (2) months beyond the existing term, if necessary, to allow for the finalization of the reappointment by the Board of County Commissioners or County Administrator, as appropriate.

    (h)

    The AAC's meetings are open to the public and its members are subject to the Florida Sunshine Law and the Public Records Act.

    (i)

    At all meetings of the AAC, each member attending shall be required to cast a vote on all matters requiring action by the AAC. Any member who has a conflict of interest on any issue being voted upon shall recuse themselves from voting on matters relating to the issue. The member must have a special gain or loss as defined by the Florida Commission on Ethics in order to have a conflict of interest. The member should consult with the County Administrator's office as to whether a conflict exists. In the event of a conflict, the required form must be completed and made a part of the minutes. The nature of the conflict and recusal shall be stated prior to the applicable vote.

Editor's note

Ord. No. 2018-17, § 1, adopted September 25, 2018 provided that the AAC shall sunset on September 30, 2024, and the ordinances governing the AAC, section 3-47 inclusive, shall be repealed effective on September 30, 2024.
