§ 28-382. Prohibition of illicit connection.

  • (a)

    Any point source discharge to the county's MS4, regulated waters or waters of the state that is not composed entirely of stormwater or specifically permitted through a NPDES permit, is considered an illicit connection and is prohibited. The construction, use, maintenance or continued existence of illicit connections to the county's MS4 is prohibited. Failure of an industrial facility or construction site to notify the county administrator of a connection to the county's MS4 prior to discharging constitutes an illicit connection.

    (b)

    This prohibition expressly includes, without limitation, illicit connections made in the past, regardless of whether the connection was permissible under law or practices applicable or prevailing at the time of connection.
