§ 19-6. Variances.

  • (a)

    The mine operator may apply to the county for granting of a variance from any of the standards and procedures established in this chapter. To be considered for approval, the applicant is required to demonstrate that the proposed methods of operations, standards or buffering would provide a level of protection to the adjoining properties consistent with the standards of this chapter.

    (b)

    A variance may be granted when it is established that existing permitted operations make it impractical or unreasonable to comply with the terms of this chapter.

    (c)

    Variances issued under this chapter shall be granted by the board of county commissioners under the same procedures applicable to variances to zoning regulations.
